The Federal Communications Commission
has set rules to implement the Junk Fax Prevention Act of 2005. The FCC says that fax advertisements only can be sent to those with whom the sender has an established business relationship. Even those with an EBR must have agreed to make their number available. Junk faxes must have "clear and conspicuous" opt out options under the rules, which extend to small and nonprofit trade associations. The rules will take effect 90 days after being published in the Federal Register.
